If you’ve just resigned, been laid off, or are exploring your next step in the UAE, one of the biggest questions you might have is: How long can I legally stay in the UAE after my visa is cancelled?

Many residents still assume the grace period is only 30 days. But under the UAE’s revised immigration system, introduced in late 2022, grace periods now range from 30 to 180 days, depending on your visa type and job classification.

Understanding how the system works is essential, especially if you’re planning to change jobs, start a business, or apply for a different type of visa.

What is the Grace Period?

A grace period is the amount of time you are allowed to legally remain in the UAE after your residence visa is cancelled or expires. During this period, you can:

  • Transfer your visa to a new employer or sponsor
  • Switch to another type of visa (freelance, investor, partner, etc.)
  • Exit the country without penalties

If you overstay beyond your grace period, fines apply at AED 50 per day.

Here is the latest breakdown of UAE visa grace periods:

What Are MOHRE Skill Levels?

MOHRE (Ministry of Human Resources and Emiratisation) classifies job roles based on education, skills, and professional experience.

  • Skill Level 1: Highly qualified roles requiring a university degree (e.g. doctors, engineers, finance managers)
  • Skill Level 2: Technical roles requiring a diploma (e.g. software developers, lab technicians)
  • Skill Level 3: Skilled workers with vocational training (e.g. sales executives, administrative officers)

If you are in Skill Level 1 or 2, you are entitled to 180 days after cancellation or expiry to sort out your legal status.

Do Dependents Get the Same Grace Period?

Yes, in most cases, dependents follow the grace period of the principal visa holder. This means if your spouse or parent is in Skill Level 1 or 2, or holds a Golden or Green Visa, you are also entitled to the same 180-day grace period.

However, if the principal visa holder has a 60-day grace period, then that same timeline usually applies to dependents as well.

Does the Grace Period Start from Expiry or Cancellation?

The grace period begins from the earlier of the two events:

  • Visa expiry
  • Visa cancellation

If your visa expires on May 1 and the company cancels it on May 10, your grace period begins on May 1, not May 10.

Overstay fines begin immediately after the grace period ends, regardless of the cancellation date.

Real-Life Examples

Case 1: Senior Architect (Skill Level 1) – 180 Days

Ravi’s visa was cancelled in February after his company closed. As a Skill Level 1 professional, he received 180 days. He used the time to explore freelance opportunities and eventually opened a design consultancy.

Case 2: Customer Service Officer (Skill Level 3) – 90 Days

Joanna was classified under Skill Level 3. When she resigned in June, her cancellation document reflected a 90-day grace period. She accepted a new job offer within 60 days and transferred her visa without needing to exit the country.

Case 3: Administrator – Grace Period Misunderstood

Ahmed’s visa expired in April, but wasn’t cancelled by his company until May. He assumed the 60-day period started from cancellation. It did not. He was fined for overstaying after his grace period (from the expiry date) had already lapsed.
